Member Agreement/Terms of Use
SAFETY & UNSTAFFED FACILITY POLICIES
PLEASE READ CAREFULLY
Members are required to sign this Agreement, the Member and, if the Member is under the age of eighteen (18), the Parent/Legal Guardian acknowledge and agree to the following:
Unstaffed Facility
High Percentage Athletics operates as a controlled-access facility. Staff members or coaches may not be present during all operating hours. Members understand they may be using the facility without employees on site.
Parent Authorization for Minors
Members who are fourteen (14) through seventeen (17) years of age may access the facility without a parent or guardian physically present only if a Parent or Legal Guardian has completed and signed all required membership documents, waivers, and authorizations.
Parent Responsibility
The Parent or Legal Guardian of any Member under eighteen (18) remains fully responsible for the Member's conduct, compliance with facility rules, property damage, misuse of access credentials, payment of damages or fees, and maintaining current emergency contact information.
Security Monitoring
Members understand and consent that the facility is monitored by video surveillance and electronic access control systems twenty-four (24) hours per day. Entry times, exit times, and activity within the facility may be recorded.
Personal Responsibility
Members agree to exercise reasonable judgment while using the facility and acknowledge they are responsible for using equipment safely and within their own physical abilities.
Emergency Procedures
Members acknowledge that no employee may be immediately available. Members agree to call 911 during emergencies, notify High Percentage Athletics as soon as reasonably possible, and familiarize themselves with posted emergency procedures.
Access Credentials
Access codes, key fobs, mobile credentials, or other entry methods are assigned to individual Members only and may not be shared, loaned, copied, or used by any other person.
No Unauthorized Guests
Only Members with a valid reservation and authorized access may enter the facility. Members shall not admit unauthorized individuals into the facility.
Tailgating Strictly Prohibited
Allowing another individual to enter the facility using your access credentials ('tailgating') is strictly prohibited and is grounds for immediate suspension or permanent termination of membership without refund.
Violation of Policies
Violation of facility rules, unauthorized entry, credential sharing, vandalism, theft, misuse of equipment, or unsafe conduct may result in immediate suspension or termination of membership without refund and financial responsibility for damages.
Assumption of Risk
The Member and Parent/Legal Guardian understand that participation in basketball training and use of an unstaffed athletic facility involve inherent risks, including serious injury or death, and voluntarily assume such risks to the fullest extent permitted by law.
Privacy Policy
Introduction
High Percentage Athletics LLC ('High Percentage') respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, store, share, and protect your information when you use our website or services.
Information We Collect
We may collect contact information, account details, membership information, reservation history, emergency contacts, parent/guardian information, payment information through third-party processors, website analytics, cookies, device information, and security camera footage.
How We Use Information
We use information to provide memberships, reservations, training, communications, payment processing, customer support, marketing where permitted, safety, security, legal compliance, and business operations.
Information Sharing
We do not sell personal information. We may share information with payment processors, scheduling software providers, website hosting providers, insurers, attorneys, and government authorities when legally required.
Security
We maintain reasonable administrative, technical, and physical safeguards to protect personal information.
Photography and Video
Security cameras are used throughout the facility for safety and monitoring. Photos and videos may be used as permitted by participant agreements and applicable law.
Your Rights
Subject to applicable law, you may request access to and opt out of marketing communications.
